FACTS: The Plaintiff was a passenger in a vehicle that was struck by Defendant’s vehicle. The Plaintiff was in the backseat passenger of a work van that did not have windows. As a result, the Plaintiff was unprepared for the impact. The Plaintiff suffered low back injuries that eventually required surgery. The Plaintiff had a successful surgery. Farar Law was able to recover the Defendant’s policy limits in the amount of $100,000.00 as well as the policy limits under the owner of Plaintiff’s vehicle’s underinsured motorist provision in the amount of $137,500.00 (after a $12,500.00 worker’s compensation offset).
